1. Eligibility
You must be at least 18 years old to use the service. No exceptions. We do not offer parental-consent flows and the service is not designed for or directed at minors. By creating an account you represent that you are 18 or older, that you are not on any US sanctions list, and that your use of the service does not violate the laws of your jurisdiction.
2. Your account
You are responsible for keeping your credentials secure and for everything that happens under your account. Notify us immediately at hello@oddsmiami.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these terms, that we reasonably believe are operated by bots, or that pose a safety risk to other users. You may delete your account any time in Settings → Account → Delete account.
3. Acceptable use
You agree not to use the service for any unlawful purpose, to harass or threaten other users, to post defamatory, hateful, sexually explicit, or violently graphic content, to scrape or reverse-engineer the service, to reuse other users' content outside the service without permission, to submit false events or fake RSVPs, or to manipulate the verification system. We may remove content that violates these rules and may suspend or terminate offending accounts.
4. Events and physical activity
ODDS · Miami helps you find and organize running events. Running and other physical activities carry inherent risk of injury, including serious injury or death. You are responsible for your own physical condition, hydration, route awareness, traffic safety, and gear. Event hosts are independent users, not employees or agents of Goc Ventures Group LLC — the service is a discovery and coordination tool. RSVP'ing signals intent to attend but does not guarantee entry, completion, or safety. Consult a physician before starting a new exercise routine if you have any medical condition.
5. Assumption of risk and release
You waive, release, and hold harmless Goc Ventures Group LLC, its officers, employees, and other users from any claim arising out of your participation in any event found, listed, or organized through the service, to the maximum extent permitted by law.
6. Your content
You retain ownership of everything you post — events, comments, photos, messages. By posting you grant us a non-exclusive, royalty-free, worldwide license to host, store, reproduce, display, and transmit that content for the sole purpose of operating and providing the service to you and to the audience you choose. The license ends when you delete the content, except for backup copies kept in our rolling backup window, content other users have already saved or quoted, and anonymized or aggregated derivatives. We do not use your content to train AI models without your separate, opt-in consent.
7. Reporting and DMCA
If you believe content on the service infringes your copyright, see /dmca for the notice procedure. To report harassment, safety threats, or terms violations, email hello@oddsmiami.com or use the in-app report function. We maintain a registered DMCA agent under 17 U.S.C. § 512(c); details at /dmca.
8. Paid features
There are currently no paid features. If we launch paid features (e.g. VIP events, subscriptions), separate terms and disclosures — including California auto-renewal disclosures where applicable — will be presented at checkout. Using a paid feature constitutes agreement to those additional terms.
9. Service availability and changes
We do our best to keep the service running but offer no uptime guarantee. We may suspend, modify, or discontinue any feature at any time, with or without notice. We try to give advance notice for material changes that affect data you've created.
10. Disclaimers
THE SERVICE IS PROVIDED 'AS IS' AND 'AS AVAILABLE', WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. We do not warrant that the service will be uninterrupted, secure, error-free, or free of harmful components.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOC VENTURES GROUP LLC AND ITS DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) US$100. Some jurisdictions do not allow exclusion of certain warranties or limitation of liability; there, our liability is limited to the maximum extent permitted by law.
12. Indemnification
You agree to defend, indemnify, and hold harmless Goc Ventures Group LLC and its officers, employees, and agents from any claim arising out of your use of the service, your content, your violation of these terms, or your violation of any law or third-party right.
13. Governing law and venue
These terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Any dispute that is not subject to small-claims court must be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction there. We are not currently requiring binding arbitration or a class-action waiver; if we add either, we will give 30 days' notice and an opt-out window before they take effect for existing users.
14. Termination
You may stop using the service at any time. We may suspend or terminate your account for breach of these terms, suspected fraud, safety risk, or extended inactivity. Sections that by their nature should survive termination (content license for backups, disclaimers, limitation of liability, indemnification, governing law) survive termination.
15. Changes to these terms
For material changes we will give at least 30 days' notice via in-app banner and the email on file. Your continued use after the notice period constitutes acceptance. For non-material changes (clarifications, typo fixes, address updates) we update the 'Last updated' date above.
16. Miscellaneous
These terms plus the privacy policy and any feature-specific terms constitute the entire agreement between you and us regarding the service. If any provision is unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights under these terms; we may assign ours to an affiliate or in connection with a merger or sale.
